General Terms and Conditions of BALSA online shop
Splošni pogoji poslovanja trgovine BALSA (v nadaljevanju: “splošni pogoji”) so sestavni del vseh ponudb in pogodb med podjetjem BALSA d.o.o., Loka 63,4290 Tržič, davčna številka: SI (v nadaljevanju: “BALSA”, “podjetje BALSA”, “podjetje” ali “prodajalec”) in fizično ali pravno osebo, ki opravi nakup blaga v trgovini BALSA (v nadaljevanju: “kupec” ali “vi”).
These General Terms and Conditions apply to any purchase made in the BALSA shop, whether in the online shop or when concluding a distance contract.
In the case of purchase of goods through the online shop, the General Terms and Conditions of the online shop shall also apply. www.balsa.si.
- Definitions 1.1. “Prodajalec” je trgovina BALSA, ki se ukvarja s prodajo blaga.
1.2. “Kupec” je fizična ali pravna oseba, ki kupi blago od prodajalca.
1.3. “Spletna trgovina” pomeni prodajno mesto na spletni strani www.balsa.siwhere the customer orders and buys goods online.
1.4. “Pogodba sklenjena na daljavo” je pogodba, sklenjena med prodajalcem in kupcem prek komunikacijskih sredstev, kot so telefon, elektronska pošta ipd., brez hkratne fizične prisotnosti obeh strank.
- Offer and prices 2.1 All prices for the Goods are expressed in Euro and include VAT, unless otherwise stated.
2.2 The Seller reserves the right to change prices without prior notice.
2.3 All information contained in tenders, including price, quantity and availability of goods, is for information purposes only and does not constitute a binding offer unless expressly stated otherwise.
2.4 The information provided on the Seller's website (e.g. pictures, samples) is intended only as an approximate description of the goods.
- Inspection of goods before purchase 3.1 The Buyer must check the suitability of the goods selected before purchase. In case of any questions, the Buyer may contact the Seller.
3.2 The Seller shall not be liable for technical advice given to the best of his knowledge, but this shall not relieve the Buyer of the obligation to check the suitability of the Products.
- Account and payment terms 4.1 The Buyer shall check the accuracy of the invoice and notify the Seller immediately of any errors.
- Delivery times 5.1 Unless otherwise agreed, delivery times are estimates only.
5.2 Delivery times may be extended if there is a delay due to events beyond the Seller's control (e.g. force majeure).
- Delivery 6.1 If the Buyer and the Seller agree on delivery, this service shall be charged in accordance with the applicable price list.
6.2 The Seller shall determine the method of delivery and the Buyer shall provide a suitable delivery address.
- Checking goods before use 7.1 The Buyer must inspect the Goods prior to installation, as subsequent claims arising from the installation of damaged Goods are not possible.
- Complaints 8.1 All complaints shall be dealt with in accordance with applicable law.
- Protection of personal data 9.1 Customer data shall be processed in accordance with the legislation on the protection of personal data.
- Complaints and disputes 10.1 Any disputes shall be governed by Slovenian law and the court in Kranj shall have jurisdiction.
These General Terms and Conditions are valid from 01.10.2024.
